Goosed by Lawsuit Abuse?

Click here for the videoWhen two Canada geese landed in the planter outside Howard Weiss' and Kelly Reed's store -- the Migratory Species Act prevented them from removing the winged visitors.

But when one of the geese scared a woman outside their store -- they were slapped with a $750,000 lawsuit.

That's right -- because of the Migratory Species Act, it would have been illegal for them to disturb the geese.

But one day, the male goose flapped his wings, honked, and snapped at a woman walking to the fabric store next door to Howard and Kelly's small pool maintenance store.

Startled, the woman fell on the sidewalk.

Two years later, Howard and Kelly were served with papers announcing that the woman was suing their store for $750,000 -- alleging that the goose was their responsibility.

After going to trial, the store was found to be not negligent in this case.

But Howard says that the costs of lawsuit abuse to small businesses are not just financial. They include "the time taken away from your business -- the way you run your business. You start to second guess how you do business because you're worried about the next lawsuit, and that's not the way to run a company."
